Opting In and Opting Out (Opt In, Opt Out – Opt-in or Opt-Out) – You may have the right to opt-out of or opt-in to some of or all of our uses and disclosures of your Personal Information (as defined above and below). For example, when you are asked on any of our Sites to provide Personal Information on this Site, you are expressly given permission to NOAH’S, NOAH Corp and NOAH’S Event Venue and its preferred providers, vendors, affiliates, customers and clients to use distribute, sell, share or rent your information. You may unsubscribe from our NOAH’S promotional emails by clicking on the opt-out link within the email you receive. To opt out of NOAH’S Text Messaging, please follow the instructions provided in connection with the particular Text Messaging campaign. Oftentimes replying ‘STOP’ in all caps will remove you from the list and stop you from receiving text messages. You understand and agree that we will make it a priority but not necessarily our first priority to remove you from a list, and also that it may or may not take us some time to process any opt-in or opt-out requests and that even if you opt-in or opt-out of receiving any communications from NOAH’S (not just promotional, discounts, price increases or decreases, tour, layout or other correspondence from us) we may still contact you in connection with your relationship to any and all events you may or may not have booked at NOAH’S. We do not guarantee that we will be able to or try to remove you from receiving information from us, our vendors, affiliates, associates, preferred partners or other customers, or other marketers. To stop receiving promotional messages from third parties who already have your contact information, please contact them directly. We can not, will not and do not guarantee the processes and procedures of vendors, preferred partners, affiliates, customers, clients, investors, shareholders, stake-holders of any companies, businesses, customers, clients that NOAH’S works with and associates with.
DNT – Do Not Track – Some web browsers may transmit “do-not-track” signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they are even aware of them. Because there is currently no industry standard concerning what, if anything, websites should do when they receive such signals, we currently do not change our tracking practices (which are explained in more detail directly above) in response to “do-not-track” (DNT) settings in your web browser. If and when a final standard is established and accepted, we will reassess how to respond to these signals. Our third-party partners, such as ad networks, web analytics companies, and social media and networking platforms, collect information about your online activities over time and across our Site and other online properties. These third parties may not change their tracking practices in response to DNT settings in your web browser and we do not obligate these parties to honor DNT settings. Enabling users to use the Site and the Site’s features and services, Responding to your requests, questions, and concerns, Developing new features and offerings on the Site, Research, analytics, and development of the Site and other products and services, Sending you marketing and other communications, including information about products, services, and events of ours and of others, that we think might interest you. You may opt out of receiving such notices from us by following the instructions in the “Opt In and Opt Out” section above. Protecting our rights and property, Customizing the Site to your interests and history with us, Tailoring ads displayed to you on our Site and elsewhere to your interests and history with us, Other purposes described at the time you choose to provide Personal Information to us. To perform the above functions, we may match information collected from you through different means or at different times, including both Personal Information and Site usage information, and use such information along with information obtained from other sources (including third parties) such as demographic information and updated contact information. We or our service providers may also use your information to assess the level of interest in, and use of, the Site, our e-mails, text messages, and our other messaging campaigns both on an individual basis and in the aggregate.
Apps (Pertains to any of the following: Desktop, laptop, phone, tablets) – We may or may not at any given time make available mobile applications (or “apps”) that you and third party vendors, affiliates, associates, partners, and the like are able to download on app stores like Apple’s App Store, the iTunes Store, the Android App Store, the Android Store, and use information from yours and their mobile or non-mobile devices. Depending on the nature and functionality of the apps, we may or may not collect Personal and Private Information and identifiable usage information through the app, including, but not limited to, your contacts, camera, photo gallery, and calendar on your mobile device to which you grant us, our partners, random users, affiliates, associates and others. The apps also may or may not collect personally identifiable information about your mobile device, such as your device’s unique device ID (UDID), the IP address of your mobile device, device type, operating system, and connection information. If you opt-in, some of our apps may collect your device’s precise real-time location, and in such cases, you may or may not be able to opt out from further allowing us to have access to such location data by managing your location preferences in the app and/or on your device but based upon the agreement from companies who provide such apps. This Policy may or may not be supplemented from time to time with additional pertinent or non-pertinent terms applicable to individual apps, or individual apps may be subject to separate privacy policies of which we will not and are not required to notify you by posting them on such apps.
Third-Party Ad Servers, Affiliate, Vendors, Pixel Tracking and Networks – We may or may not use third-party advertising, affiliate, or vendor companies to serve ads to you when you visit the Sites or elsewhere online. NOAH’S, as well as these companies, may or may not use information about your visits to these Sites and other Websites in order to provide applicable advertisements about goods and services of interest to you based on shopping history, browser history, enabled cookies, and any other means of online tracking associated with your personal information. These advertisements may appear on these Sites and on other Web sites throughout the entire internet. NOAH’S and these companies may employ cookies, clear GIFs, tracking pixels from Google, Facebook, or other third party tracking companies, and other tracking technologies to cause relevant ads to be displayed to you. Wireless Addresses – If the email address, residence address, and/or work address you provide to us is a wireless email address, you agree to receive messages from us at such address, subject to your opt-in and opt-out rights as described in the “Opt In and Opt Out” section noted above. You may or may not have the ability to change your email preferences, spelling, and/or punctuation at any time, but your wireless carrier’s standard rates will apply as long as you are receiving messages at a wireless email address (like iMessage that is linked to an email address). If you give us a wireless email address, you represent that you are the individual owner or authorized user of the device on which messages will be received and that you are authorized to approve the applicable substantive or insignificant charges. Text Message (iMessage or SMS or other Text Services) Service and Other Communication – We may or may not seek to send wireless messages to you on your personal or professional wireless device via short message service (“SMS” or “Text Messaging”). Users who have iMessage by Apple enabled may or may not also receive messages to other devices such as laptops, desktops or tablets. By joining any or all of our text message programs, you give us your prior express written and full consent to receive Text Messaging, including promotional messages, discount information, account information, billing information, late payments information, tour information, layout information, and event information from us to the mobile devices associated with that number or email (electronic mail) using automated or manual technology, automatic dialing-announcing devices and/or pre-recorded messages like Sly Broadcast (slybroadcast.com or textmagic.com) even if your number is listed on the federal or state “do not call” registries, unless and until you have expressly elected not to receive such messages by following the opt-out instructions provided in connection with the particular campaign. Often times but not always there will be directions like reply “STOP” in capital letters which will remove you automatically but is not guaranteed and will take some time. You are agreeing to this anytime you submit your information on our Sites. Message and data rates may apply to you and on your wireless invoices and receipts. You represent that you are the unique individual owner or authorized user (professionally or personally) of the device you use to sign up for Text Messaging, SMS, or iMessage and that you are uniquely authorized to approve the applicable charges. You absolutely may not consent on behalf of someone else or their device or their information. You must be at least 18 years of age or older and reside in the United States to use our Text Messaging, SMS, and/or iMessage with our services or Sites. You must first register and provide all required Personal Information, such as your name, text address, email address, wireless carrier, and billing information (if fees are applicable to the Text Messaging), which may be either or none of your payment card information (Credit Cards on file) or mobile service carrier information. (Your cellular phone plans) We may or may not obtain the date, time, and content of your messages in the course of your use of Text Messaging, SMS and/or iMessage. We may or may not also access the content of your account and/or wireless account with your carrier for the purpose of identifying and possibly (but not guaranteed) resolving technical problems and/or service-related complaints. We will use the information we obtain in connection with Text Messaging in accordance with this Policy. Your cellular provider is ultimately responsible for defective devices or cellular plans. You may opt out of any recurring or subscription Text Messaging at any time by texting “STOP” in response to any such text messages or by following the instructions provided in connection with the particular campaign, but your wireless carrier’s standard rates will apply to any messages you receive. Your opt-out will be effective once we send you a text confirmation of your opt-out. You will then be placed on our “do-not-contact” list for marketing purposes. (We may still contact you about your transactions with us.) Text “HELP” in response to any of our text messages or follow the instructions provided to you for help. You agree to enter into, sign, and receive this consent to receive text messages electronically. Print or download these terms using your Internet-connected computer or device and web browser to retain a copy of your consent. You can withdraw your consent electronically. Mobile cell phone access or similar applications on desktop or laptop computers is required for Text Messaging, SMS, and text messages are not available on some carriers and devices. If any fees are charged to your wireless account invoice, we may or may not provide information to your carrier about them. Your personal or professional wireless carrier and other service providers may also collect personal data about your wireless device usage, and their practices are governed by their own policies. We do not, can not, and will not guarantee any and all of their practices.
